Romania: Media claim winning song is in breach of rules
Last night, during the Capatos live show where Luminita Anghel and Tony Tomas were invited, the host of the show presented a document showing that the track Playing with fire has been registered with the Norwegian IFPI (Tono) as co written and co penned by Ovi Cernauteanu (Ovi) and Norwegian composer Simen Eriksrud. According to the new TVR regulation regarding the Eurovision 2010 preselection, all authors of the submitted songs for the Romanian national final must have Romanian citizenship. Dan Capatos stated that, if the information is confirmed, he will officialy ask TVR to disqualify Playing with fire and organise a new National final.
Earlier today, Esctoday.com received from TVR a document signed by Mr. Simen Eriksrud which states: "I personally confirm that Ovi (Ovidiu Cernauteanu) is the only composer of the song Playing with fire. We agreed that I would recieve 50% of the publishing rights of the song as a payment for my work as producer".
TVR will now have to decide whether they will accept Mr Eriksrud's statement which contradicts the fact that in the official Norwegian copyright association he was registered as co author and lyricist of the winning song. Also, given the fact that the author of the winning song, Ovi in this case, transferred the rights of the song to the local broadcaster for the purposes of the Eurovision Song Contest it remains to be decided whether co ownership with Mr Eriksrud could create legal issues.

If Ovi owns half the royalties, how can he pass the rights to TVR? Isn't there a legal problem there?
Great news! My best wishes to Ovi. Although I'm still not yet convinced with the song, so lets wait... Europe is a Pandora's box maybe we could see a Bucharest 2011? Who knows!
Aris Kalimeris from OGAE Romania, who wrote this post from esctoday, posted the article from Adevarul magazine(partner of Eurovision Romania 2010)... where Marina Almasan and the Romania TODO confirmed that Ovi is the only composer.... so Paula and Ovi can participate with their song...

let me correct you.... "could happen only to eurovision" cause Romania is not the only country that has been involved in a "scandal" .. the problem with the "cheep gosip" was already gone by the time you taped your message...

Luminita is gelous that si didnt win.I voted bouth Pala and Luminita but after this i have to say she is a b...ch.I hope the song remains because the Save their lives song was bad live.
UCMR, the Romanian TONO said is a common practice for the producers to sign for their songs, to appear as co-composers, from financial purposes... so Paula and Ovi can remain the winners of Eurovision Romania 2010...

yesterday Marina Armasan and Paula were invited with Paula to a show where Marina Almasan herself answered to some questions about this situation and she said everything is alright...

Lorena Maseluta, I think you are Paula Seling or you are obssesed with her. Chill out. TVR send nothing to esctoday, they will come soon with an official explanation. You need to stop posting lies. Most of us are interested to hear from an official, not from a desperate fan.
tvr and even Mihai Traistariu knew about the TONO document and the other 2 documents from the preselection so there's no chance for the song to be disqualified 
because they all knew about all this...
Oh, if they go to Oslo, that's good! It will be cruel to disqualify them now!

This is what Eriksrud said in Norwegian newspaper:
"Eriksrud - which among other things, has helped to write Donkey Boys "Ambition" and Bjørn Johan Muris "Yes Man" from MGP, says to the Romanian state broadcaster TVR that he HAS NOT been involved in writing Ovis winning song.
He is listed as the co-composer (not writer) due to the reason he is getting half of the royalties as a reward for him producing the song".

Ovi Martin has written the song, Simen Eriksrud has produced it. So Eriksrud is not the "author" of the song, Ovi Martin is the sole author. So there is the difference...
As every year the rumors are spread up. This happens usually and the results are always the same...everything was just made to call the media attention and nobody broke the rules. Good luck to Play with fire in Oslo and my best wishes to Romania!
This happens every year here. Some people don't know how to lose that show is just crap with all kinds of gossip for ratings.
